Terms and conditions
Provided by Comprara Group Pty Ltd and its associated companies.
Last updated 17 October 2026
These terms apply whenever you buy from SkillsGAP Analysis, whether you buy an assessment online for yourself or your organisation engages us to run an assessment program for a team. Part A applies to everyone. Part B covers assessments bought and taken online. Part C covers programs we deliver for organisations.
If a proposal or quotation we have given you for a particular engagement says something different, the proposal or quotation applies to that engagement. Terms printed on a purchase order do not change these terms unless we agree in writing.
Part A. For everyone
1. Who we are
SkillsGAP Analysis is a service of Comprara Group Pty Ltd (ABN 57 642 065 594), Level 6, 365 Little Collins Street, Melbourne VIC 3000 ("we", "us"). "You" means the person or organisation buying from us. A "participant" is the person who takes the assessment, whether that is you or someone you register.
2. Prices, GST and payment
Prices are in the currency stated at checkout or in your quotation or invoice. GST is added for Australian buyers. We issue a tax invoice for every purchase.
Where we offer card payment, you pay by card at the time of purchase through our payment provider, Stripe, and we send you a tax invoice or receipt. Card details are entered on Stripe's payment page and are not held by us. Where we invoice you instead, each invoice is payable within 30 days of its date. Programs for organisations are invoiced as set out in Part C. If an invoice is still unpaid 30 days after it falls due, we may pause the assessments, or the participants' access, until it is paid.
3. Content and copyright
Copyright in our assessments, questions, frameworks, reports, benchmarks, templates and tools, and in the platform that delivers them, stays with us or our licensors. Providing an assessment or a report does not transfer ownership to you or anyone else.
A participant may use their own results and report for their own development and in the normal course of their work. The assessment content must not be copied, shared, published or resold without our written permission.
If you give us your own documents or data to use in an assessment, they remain yours, and you confirm you have the right to let us use them for that purpose.
4. Your rights under the Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under that law.
5. Our liability
If our services are not of a kind ordinarily bought for personal, domestic or household use, our liability for failing to meet a consumer guarantee is limited to supplying them again or paying the cost of having them supplied again.
Otherwise, the total liability of either of us to the other for a purchase is limited to the fees paid or payable for it, and neither of us is liable for indirect or consequential loss. This does not limit your rights under the Australian Consumer Law, fees owed to us, liability for personal injury or fraud, or a breach of clause 3, 7 or 16.
6. Participant information and privacy
We handle personal information as set out in our privacy policy. Where an employer has arranged an assessment for its people, we may give the employer each participant's completion status and results. Our privacy policy tells participants this, and the employer will also let its participants know.
7. Confidentiality
Each of us may see the other's confidential information in the course of the assessment. Neither of us will disclose it unless it is already public, the law requires it, or the owner agrees or the disclosure is needed to deliver the assessment.
8. Using results
An assessment shows a person's responses against a framework at the time they take it. Results and reports are a decision aid and are not a guarantee of how a person will perform. You are responsible for how you use results, including any decision about an employee or candidate.
9. Events outside our control
Neither of us is responsible for failing to meet an obligation because of something outside our reasonable control. Online assessments can be affected by delays, outages and other problems with the public internet or your own equipment, which are outside our control. If we cannot provide an assessment you have paid for, we will give you access again, extend your access or refund the part not provided. This clause does not excuse paying an amount already due.
10. Changes to these terms
We may update these terms from time to time. The terms on this page when you buy apply to that purchase.
11. General
We may use contracted staff or partners to provide the service, and we remain responsible for their work. You may not transfer your rights under these terms without our written consent.
These terms, the policies they refer to and any proposal or quotation we have given you are the whole agreement between us about the assessments. If any part of these terms is found to be unenforceable, the rest still applies. If we do not enforce a right straight away, we have not given it up.
These terms are governed by the laws of Victoria, and the courts of Victoria have jurisdiction over any dispute.
You can contact us about these terms at info@skillsgapanalysis.com. We write to you at the email address you gave us.
Part B. Online assessments
12. What you buy
Each assessment and pack is described on its page on this website, or in the quotation we give you. The description and price shown when you buy form part of your agreement with us.
Assessments are delivered through our online platform. Once your order is confirmed we register the email address you give us, or send it an invitation to take the assessment. If you are buying for someone else, tell us before the participant starts and we will register the assessment to them.
13. Licences and access
Each licence is for one participant. A licence gives the participant access to the assessment for the period stated when you buy, and six months from the day they register if no other period is stated. When access ends the participant can no longer open the assessment. Reports already issued to the participant are not affected.
14. Reassigning a licence
A licence cannot be shared or used by more than one person. If a participant leaves your organisation or changes role before using their licence, you can ask us to move it to a replacement. Email us at info@skillsgapanalysis.com and we will reassign it.
15. Cancelling and refunds
You can cancel a purchase before the participant starts the assessment by emailing us, and we will refund it. Once an assessment has been started, we do not refund it unless the Australian Consumer Law requires us to or we have not been able to provide it as set out in clause 9.
16. Your login and fair use
A login is for one person and must not be shared. A participant, and you, must not:
- copy, record, publish or resell any assessment content or questions;
- use the content or the platform to build a competing product or service, or to monitor or benchmark the platform;
- reverse engineer the platform, or interfere with it, or try to gain access to any part of it you have not been given;
- send or store unlawful material or anything harmful to the platform; or
- give false details to gain access.
You are responsible for activity under the accounts you register. Tell us straight away at info@skillsgapanalysis.com if you think someone else is using a login. If a login is used in serious or repeated breach of this clause, we may suspend it while we check, and close it if the breach is confirmed. Unless it is urgent, we will tell you why and let you respond first.
17. Your data
You own the information you and your participants submit to the platform. We use it to provide the assessment and reports. We also use results in combined form, with nothing that identifies a person or organisation, to build benchmarks and analyse trends, and we own that combined information. If your agreement with us ends, we may delete your data more than 30 days after you are de-registered.
18. Changes to assessments
We keep our assessments up to date and may change their content, questions or reports. We will not make a change that materially reduces what you paid for. If we withdraw an assessment before a participant's access to it ends, you can choose a comparable assessment or a refund for the unused part.
19. Your equipment and other services
You need a suitable device and internet connection to take an assessment. We are not responsible for the content of other websites we link to.
Part C. Programs for organisations
This part covers assessment programs, group reports, tailored assessments and capability programs that we deliver for an organisation (the "client") under a proposal or quotation.
20. Management and administration
The client manages and administers the program on its side: it nominates a coordinator, identifies the participants, passes on our instructions to them, and makes sure they comply with clauses 3 and 16. We will respond promptly to requests for information and provide reports where asked.
21. The program
We provide the people and resources needed to deliver the program set out in the proposal, which may be amended if we both agree. We will deliver it with due care and skill. A significant change to the scope of the program that needs further research or redevelopment, such as a tailored assessment or capability framework, may attract additional fees, which we will agree with the client before doing the work.
22. Fees and expenses
The fees in the proposal cover the assessments, administration and reports described in it. Unless the proposal says otherwise, they do not include travel, accommodation or meals, which are charged at cost. Work the client asks for outside the scope of the program is charged at the rate in the proposal, plus expenses.
23. Invoicing
We invoice fees and expenses as the proposal sets out. Expenses are charged at cost and itemised on the invoice, and receipts are available on request. Invoices are payable within 30 days, and we can invoice against the client's purchase order.
24. Changes and cancelling
Changes to the dates or scope of a program are agreed in writing. If the client cancels a program, it pays for the work done and the expenses incurred up to the date we receive its written notice, and the fee for any assessment licences already issued. If we have to postpone a program, we will agree new dates at no extra charge. If none suit, we will refund what the client has paid for the part not delivered.
25. Shortfalls caused by the client
We are not responsible for a shortfall in the program caused by the client not meeting these terms, for example participants or information not being available as agreed.
